By accessing our website hittsurveyors.com or engaging the services of HITT Land Surveyors, Inc. ("HITT Land Surveyors," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully.

2. Services Provided

HITT Land Surveyors, Inc. provides land surveying services, including but not limited to boundary surveys, topographic surveys, ALTA/NSPS land title surveys, construction staking, and other related services as agreed upon in a separate written agreement or proposal.

3. Quotes and Agreements

  • Quotes: Any quotes provided by HITT Land Surveyors, Inc. are valid for a specified period and are subject to change based on the scope of work, site conditions, and other relevant factors.

  • Agreements: The specific terms and conditions for our services will be outlined in a separate written agreement or proposal that will be provided to you for your review and acceptance. These Terms are incorporated by reference into any such agreement.

4. Client Responsibilities

As a client of HITT Land Surveyors, Inc., you are responsible for:

  • Providing accurate and complete information relevant to the project, including property boundaries, existing surveys, and any known encumbrances.

  • Ensuring safe and reasonable access to the property for our surveyors and equipment.

  • Obtaining any necessary permits or approvals required for the survey work, unless otherwise agreed upon in writing.

  • Making timely payments for our services in accordance with the agreed-upon terms.

  • Clearly marking property corners or providing other relevant information if requested.

5. Payment Terms

Payment terms will be outlined in the individual service agreement or proposal. Unless otherwise specified, invoices are due and payable upon receipt. We may charge interest on overdue balances.

6. Intellectual Property

Unless otherwise agreed upon in writing, HITT Land Surveyors, Inc. retains all rights, title, and interest in and to all survey documents, maps, plats, data, and other deliverables created in connection with our services. Upon full payment, you will receive a non-exclusive license to use these deliverables for the specific purpose for which they were created. You may not reproduce, distribute, or modify these deliverables without our prior written consent.

7. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION OR CONTENT ON OUR WEBSITE.  

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HITT LAND SURVEYORS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OUR WEBSITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.  

9. Indemnification

You agree to indemnify, defend, and hold harmless HITT Land Surveyors, Inc., its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your use of our website or services, or your negligence or willful misconduct.  

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services shall be exclusively resolved in the state or federal courts located in Seminole County, Florida. You hereby consent to the jurisdiction of such courts.  

11. Entire Agreement

These Terms constitute the entire agreement between you and HITT Land Surveyors, Inc. regarding your use of our website and services and supersede all prior or contemporaneous communications and proposals, whether oral or written.  

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

13. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.  

14. Modifications to Terms

We reserve the right to modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on our website. Your continued use of our website or services after the posting of revised Terms constitutes your acceptance of the changes.
